These Terms of Service (“Terms”) govern your access to and use of the BillionCore platform, including the BIN Lookup API, dashboard, and all related services (collectively, the “Service”) provided by “BillionCore”. Please read these Terms carefully before using the Service. By accessing or using the Service you agree to be bound by these Terms.
01Agreement to Terms
By registering for an account, obtaining an API key, or otherwise accessing or using the Service, you (“Customer”, “you”, or “your”) agree to be legally bound by these Terms and all policies incorporated herein by reference, including our Privacy Policy. If you are entering into these Terms on behalf of a legal entity, you represent and warrant that you have the authority to bind that entity, and references to “you” shall refer to that entity.
IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICE. YOUR CONTINUED USE OF THE SERVICE FOLLOWING ANY MODIFICATION TO THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THOSE MODIFICATIONS.
These Terms constitute the entire agreement between you and BillionCore with respect to the Service and supersede all prior agreements, representations, and understandings between the parties concerning its subject matter.
02Definitions
As used in these Terms, the following terms have the meanings set forth below:
- “API” means the BillionCore BIN Lookup application programming interface and all related endpoints, documentation, SDKs, and tools made available to you under these Terms.
- “API Key” means the unique authentication credential generated by BillionCore and assigned to your account, used to authenticate requests to the API.
- “BIN” means Bank Identification Number (also known as Issuer Identification Number or IIN) — the first 6 to 8 digits of a payment card number that identify the card network, issuing institution, card type, and country of issuance.
- “BillionCore” means the operator of the Service, its successors, and permitted assigns.
- “Customer Data” means any data, content, or information that you submit to the Service, including BIN queries and associated metadata.
- “Documentation” means the technical specifications, integration guides, and API reference materials made available at https://billioncore.tech/docs, as updated from time to time.
- “Lookup” means a single authenticated HTTP request to the API endpoint that returns BIN data.
- “Order” means a subscription purchase, pay-as-you-go top-up, or any other commercial transaction you initiate for access to the Service.
- “Plan” means a specific tier of access to the Service as described on the pricing page, including Free Trial, Starter, Growth, Scale, and Pay-as-you-go.
- “Service” has the meaning given in the preamble above, including all features, functionality, and content provided through the BillionCore platform.
- “Usage Data” means aggregated, anonymised data about how the Service is accessed and used, which BillionCore may use to operate, improve, and develop the Service.
03Eligibility
To use the Service you must: (a) be at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater; (b) have the legal capacity to enter into a binding contract; (c) not be prohibited from using the Service under applicable law; and (d) not have had a previous account suspended or terminated by BillionCore for breach of these Terms.
The Service is intended solely for business use in connection with lawful payment processing, fraud prevention, identity verification, and related commercial activities. The Service is not intended for personal, family, or household purposes.
By using the Service, you represent and warrant that you meet all eligibility requirements. BillionCore may, at its sole discretion, refuse access to the Service to any person or entity for any reason.
04Account Registration & API Keys
4.1 Registration
To access the Service you must create an account by providing accurate, current, and complete information. You agree to maintain and promptly update your account information to keep it accurate and complete. You are responsible for all activity that occurs under your account.
4.2 Account Security
You are solely responsible for maintaining the confidentiality and security of your account credentials, including your password and API Key. You must notify BillionCore immediately at security@billioncore.tech upon becoming aware of any unauthorised access to, or use of, your account or API Key.
4.3 API Keys
Upon successful registration, BillionCore will issue you one API Key. Your API Key is personal to your account and may not be shared, transferred, sublicensed, or disclosed to any third party. You are responsible for all Lookups made using your API Key, whether or not authorised by you.
Your API Key grants full access to the Service under your account and billing plan. Treat it with the same care as a password. Never embed your API Key in public source code, client-side JavaScript, mobile applications, or public repositories.
4.4 One Account per Customer
You may not create multiple accounts to circumvent usage limits, obtain additional free trial periods, or for any other reason. BillionCore reserves the right to merge or terminate duplicate accounts.
05License & Permitted Use
5.1 Limited License
Subject to your compliance with these Terms and timely payment of all applicable fees, BillionCore grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the API and Documentation solely for your own internal business purposes as described in these Terms.
5.2 Permitted Uses
You may use the Service for the following purposes:
- Identifying the issuing bank, card brand, card type, and issuer country for payment cards in connection with payment processing operations you control;
- Fraud detection, risk assessment, and transaction screening within your own products or services;
- Subscription billing, routing, and geo-based pricing decisions within your own platform;
- Chargeback and risk analytics on card-level data within your own business operations;
- Building internal tools or customer-facing payment experiences where BIN data is consumed by your platform, not resold directly.
5.3 Usage Limits
Your use of the Service is subject to the rate limits and Lookup quotas associated with your Plan. BillionCore may throttle or temporarily suspend your access if your usage materially exceeds your Plan limits or threatens the stability of the Service for other customers. Habitual over-limit usage may require an upgrade to a higher Plan.
06Prohibited Conduct
You shall not, and shall not permit any third party to:
6.1 Misuse of the API
- Use the Service in any manner that violates applicable laws or regulations, including data protection, payment card industry (PCI DSS), anti-money laundering (AML), or sanctions regulations;
- Use the Service to process, store, or transmit full payment card numbers (PANs), cardholder names, CVV codes, or other sensitive authentication data — the API accepts BIN prefixes only;
- Attempt to identify, reverse-engineer, or reconstruct individual cardholder information from BIN data;
- Submit synthetic, automated, or bulk BIN queries for the purpose of harvesting or compiling the BIN database for resale or competitive purposes;
- Circumvent, disable, or interfere with rate limits, authentication mechanisms, or any other security features of the Service;
- Use automated tools, scripts, or bots to probe, scrape, or stress-test the Service beyond your Plan limits without prior written consent.
6.2 Resale and Redistribution
- Resell, sublicense, rent, lease, or otherwise make the API or its output available to third parties as a standalone product or service without BillionCore's prior written consent;
- Cache or store API responses beyond what is reasonably necessary for the technical operation of your application, or build a competing BIN data product from API responses;
- Share, publish, or distribute API Keys or allow third parties to access the Service using your credentials.
6.3 Technical Interference
- Introduce malware, viruses, or any other harmful code into the Service;
- Conduct denial-of-service attacks, load tests above your Plan limits, or any activity that degrades Service performance for other users;
- Attempt to gain unauthorised access to BillionCore's systems, infrastructure, or other customers' data;
- Reverse-engineer, decompile, or disassemble any component of the Service except to the extent expressly permitted by applicable law.
BillionCore reserves the right to immediately suspend or terminate your access to the Service upon detecting any prohibited conduct, without liability and without prejudice to any other remedies available.
07Fees & Payment
7.1 Pricing
Fees for the Service are as set out on the pricing page at https://billioncore.tech/#pricing and in any Order you place. BillionCore reserves the right to change pricing at any time, provided that price increases for existing paid Plans will be communicated with at least 30 days' written notice.
7.2 Subscription Plans
Subscription Plans (Starter, Growth, Scale) are billed monthly in advance. Your subscription begins on the date your Order is confirmed and automatically renews for successive monthly periods unless you cancel before the renewal date via your dashboard or by contacting support. Cancellation takes effect at the end of the current billing period; you retain access to the Service until that date.
7.3 Pay-as-you-go
Under the Pay-as-you-go Plan, you pre-fund your account balance and are charged $0.005 per Lookup. Lookups are deducted from your balance in real time. When your balance falls to zero, API requests will be rejected with a 402 Payment Required response until you top up. Balance top-ups are non-refundable once applied.
7.4 Overage
If your usage exceeds the Lookup quota included in your subscription Plan, additional Lookups will be billed at the overage rate specified in your Plan, or at $0.005 per Lookup if no specific overage rate applies. Overage charges are invoiced at the end of each billing period.
7.5 Taxes
All fees are exclusive of taxes, levies, or duties imposed by taxing authorities. You are responsible for paying all applicable taxes associated with your purchases. Where BillionCore is required by law to collect taxes, such taxes will be added to your invoice.
7.6 Payment Methods & Late Payment
You must provide a valid payment method to activate a paid Plan. If payment fails for any reason, BillionCore will notify you and may suspend your access to the Service until payment is received. Accounts with outstanding balances for more than 30 days may be terminated at BillionCore's discretion.
7.7 Refund Policy
All fees are non-refundable except as expressly set out in these Terms or as required by applicable consumer protection law. BillionCore does not provide refunds for: (a) unused Lookups within a subscription period; (b) pre-funded Pay-as-you-go balances; or (c) partial billing periods following cancellation. If BillionCore terminates the Service without cause, you will receive a pro-rata refund of any prepaid, unused subscription fees.
08Free Trial
BillionCore may offer a free trial period of 30 days (“Free Trial”) giving you access to the full feature set of the Pro Plan. No credit card is required to begin a Free Trial.
Each Customer is entitled to one Free Trial only. Creating multiple accounts to obtain additional free trial periods is a material breach of these Terms. BillionCore reserves the right to verify trial eligibility and to terminate accounts that abuse the Free Trial.
At the end of the Free Trial period, your access to paid features will be suspended unless you activate a paid Plan. Data associated with your account will be retained for 30 days following Free Trial expiry, after which it may be permanently deleted.
BillionCore reserves the right to modify or discontinue the Free Trial offer at any time without notice.
09Data & Accuracy
9.1 BIN Data
BillionCore maintains a database of BIN records sourced from card networks, issuing institutions, and third-party data providers. While BillionCore makes commercially reasonable efforts to ensure the accuracy, completeness, and currency of its BIN data, the payment card industry is dynamic: issuers reassign BIN ranges, card programmes change, and new networks emerge. As a result, BIN data may be incomplete, outdated, or inaccurate.
BIN lookup results are provided for informational purposes only and must not be used as the sole basis for making payment acceptance, fraud prevention, or credit decisions. You are solely responsible for validating the accuracy of BIN data in the context of your business operations.
9.2 Customer Data
You retain all ownership rights in Customer Data. You grant BillionCore a limited, non-exclusive, royalty-free licence to process Customer Data solely as necessary to provide the Service and as described in our Privacy Policy. BillionCore will not sell, share, or use Customer Data for any purpose other than operating and improving the Service.
9.3 Usage Data
BillionCore may collect and use Usage Data — aggregated, de-identified statistics about API usage — to operate, maintain, secure, and improve the Service. Usage Data does not identify you individually and is not considered Customer Data.
9.4 Data Retention
BillionCore retains API request logs (including BIN queries, timestamps, response codes, and usage counters) for up to 90 days for billing, security, and operational purposes. Upon account termination, your data will be deleted within 60 days, except where retention is required by applicable law.
10Intellectual Property
10.1 BillionCore Ownership
BillionCore and its licensors own all right, title, and interest in and to the Service, including the API, BIN database, software, source code, algorithms, documentation, trademarks, and all related intellectual property rights. These Terms do not grant you any ownership rights in the Service or its underlying technology. The license granted in Section 5 is the full extent of your rights with respect to the Service.
10.2 Feedback
If you provide BillionCore with feedback, suggestions, ideas, or improvement requests regarding the Service (“Feedback”), you grant BillionCore a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, and incorporate such Feedback into the Service without any obligation to you.
10.3 Your Marks
Nothing in these Terms grants BillionCore the right to use your name, trademarks, logos, or other brand identifiers without your prior written consent, except as necessary to identify you as a customer in non-public business contexts.
11Confidentiality
Each party (“Receiving Party”) may have access to information of the other party (“Disclosing Party”) that is designated as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure (“Confidential Information”).
Your API Key is Confidential Information. BillionCore's pricing, infrastructure details, and non-public technical specifications are Confidential Information. The Receiving Party shall not disclose Confidential Information to any third party and shall use it only to exercise rights and perform obligations under these Terms, using at least the same degree of care it uses to protect its own confidential information of a similar nature, but no less than reasonable care.
These confidentiality obligations do not apply to information that: (a) is or becomes publicly available through no breach by the Receiving Party; (b) was rightfully known to the Receiving Party before disclosure; (c) is received from a third party without confidentiality obligations; or (d) is required to be disclosed by law or court order, provided the Receiving Party gives prompt notice to the Disclosing Party and cooperates in seeking a protective order.
12Privacy
BillionCore's collection, use, and disclosure of personal data is governed by its Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the processing of personal data as described in the Privacy Policy.
You represent and warrant that you have obtained all necessary consents and authorisations required under applicable data protection laws (including GDPR, CCPA, and similar regulations) for any personal data you submit to the Service. You shall not submit full payment card numbers, cardholder names, national identification numbers, or any other special categories of personal data to the API.
13Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BILLIONCORE EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Without limiting the foregoing, BillionCore does not warrant that:
- The Service will be uninterrupted, error-free, or available at any particular time or location;
- The BIN data returned by the API will be accurate, complete, current, or fit for any particular purpose;
- Any errors or defects in the Service will be corrected within any particular timeframe;
- The Service is free from viruses or other harmful components;
- The results obtained through use of the Service will meet your requirements or those of any regulatory authority.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you in its entirety.
14Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL BILLIONCORE, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF BILLIONCORE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
To the maximum extent permitted by applicable law, BillionCore's total cumulative liability to you for all claims arising out of or relating to these Terms or the Service, whether in contract, tort, strict liability, or otherwise, will not exceed the greater of: (a) the total fees paid by you to BillionCore in the three-month period immediately preceding the event giving rise to the claim; or (b) one hundred US dollars (US$100).
The limitations in this section apply regardless of the theory of liability and even if any limited remedy set out in these Terms has failed of its essential purpose. These limitations reflect a reasonable allocation of risk and form an essential basis of the bargain between the parties. Some jurisdictions do not allow limitations on liability for certain types of damages, so some of the above limitations may not apply to you.
15Indemnification
You shall defend, indemnify, and hold harmless BillionCore and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service in violation of these Terms or applicable law;
- Your Customer Data, including any claim that your Customer Data infringes or misappropriates the intellectual property or privacy rights of any third party;
- Your products or services that incorporate or rely on data obtained from the Service;
- Any payment processing decisions, fraud determinations, or routing actions you take in reliance on BIN lookup results;
- Your failure to obtain required regulatory approvals or comply with applicable payment industry standards (including PCI DSS).
BillionCore reserves the right to assume sole control of the defence of any claim for which indemnification is sought, at your expense. You will cooperate with BillionCore in the defence of such claims and will not settle any claim without BillionCore's prior written consent.
16Term & Termination
16.1 Term
These Terms commence on the date you first access or use the Service and continue until terminated in accordance with this section.
16.2 Termination by You
You may terminate your account at any time by cancelling your subscription through the dashboard or by contacting support@billioncore.tech. Termination will take effect at the end of your current billing period. No refund will be issued for the remainder of a prepaid subscription period.
16.3 Termination by BillionCore
BillionCore may suspend or terminate your access to the Service:
- Immediately, if you breach Section 6 (Prohibited Conduct) or any other material provision of these Terms;
- Immediately, if required by applicable law, regulation, or order of a competent authority;
- Upon 30 days' written notice, for any other reason or for no reason.
16.4 Effect of Termination
Upon termination of your account: (a) all licenses granted under these Terms will immediately terminate; (b) your API Key will be revoked; (c) access to the dashboard and all Service features will cease; (d) BillionCore will delete your Customer Data within 60 days of account closure, subject to any legal retention obligations. Provisions that by their nature should survive termination will survive, including Sections 10, 11, 13, 14, 15, 18, and 19.
17Modifications to the Service and Terms
17.1 Service Changes
BillionCore reserves the right to modify, enhance, deprecate, or discontinue any feature of the Service at any time. Where a modification would materially reduce the functionality of the Service, BillionCore will provide at least 30 days' prior notice. BillionCore will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
17.2 Terms Changes
BillionCore may update these Terms at any time. If a change is material, BillionCore will notify you by email or prominent notice in the dashboard at least 30 days before the change takes effect. Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
18Disputes & Governing Law
18.1 Informal Resolution
Before initiating any formal proceeding, the parties agree to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service (“Dispute”) through good-faith negotiation. The party seeking resolution must send a written notice describing the Dispute to the other party. The parties will have 30 days from the date of such notice to resolve the Dispute informally.
18.2 Governing Law
These Terms and any Dispute will be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
18.3 Binding Arbitration
If a Dispute cannot be resolved informally, it shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration will be conducted in English, seated in Wilmington, Delaware. The arbitrator's award will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
18.4 Exceptions
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information obligations without first engaging in arbitration.
18.5 Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS-ACTION LAWSUITS OR CLASS-WIDE ARBITRATION AGAINST BILLIONCORE. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
19General Provisions
19.1 Entire Agreement
These Terms, together with any Orders and the Privacy Policy, constitute the entire agreement between you and BillionCore concerning the Service and supersede all prior agreements, representations, and understandings relating to its subject matter. In the event of any conflict between these Terms and an Order, the Order will prevail with respect to the specific commercial terms of that Order only.
19.2 Severability
If any provision of these Terms is held by a court or arbitrator of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
19.3 Waiver
No failure or delay by BillionCore in exercising any right or remedy under these Terms will constitute a waiver of that right or remedy. No single or partial exercise of any right or remedy will preclude any other or further exercise of that right or remedy.
19.4 Assignment
You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without BillionCore's prior written consent. BillionCore may assign these Terms in connection with a merger, acquisition, corporate reorganisation, or sale of all or substantially all of its assets without your consent. Any purported assignment in violation of this section is null and void.
19.5 Force Majeure
Neither party will be liable for any failure or delay in performance caused by circumstances beyond that party's reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, governmental actions, internet or telecommunications failures, or third-party service outages. The affected party must give prompt notice and use commercially reasonable efforts to resume performance.
19.6 No Third-Party Beneficiaries
These Terms are for the sole benefit of you and BillionCore. Nothing in these Terms creates any rights in any third party.
19.7 Headings
Section headings are for convenience only and shall not affect the interpretation of these Terms.
19.8 Language
These Terms are written in the English language. In the event of any inconsistency between a translation and the English version, the English version shall prevail.
